• Application means the software program provided by the Company downloaded by You on any electronic device, named Finch.
• Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) in which the Application has been downloaded.
• Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Finch.
• Service refers to the Application.
• Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• You means the individual accessing or using the Service.

2. Acknowledgment

These are the Terms and Conditions governing the use of this Service. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions and Our Privacy Policy. By accessing or using the Service You agree to be bound by these Terms. You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

3. In-App Purchases and Subscriptions

The Application includes optional paid content and features available through In-App Purchases, including auto-renewing subscriptions ("Subscriptions") and a one-time lifetime purchase ("Lifetime Purchase").

General

All purchases are processed through the Application Store from which you downloaded the Application (i.e., the Apple App Store or Google Play Store) and are governed by their respective terms and conditions. We do not have access to your payment information.

Subscriptions

Subscriptions automatically renew for the same price and duration period (e.g., monthly or yearly) unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel Your Subscriptions by going to your account settings in the Application Store after purchase.

Lifetime Purchase

The Lifetime Purchase is a one-time payment that grants you access to all premium features available at the time of purchase, for as long as the Application is available.

Refunds

All refund requests are handled by the Application Store (Apple or Google) and are subject to their refund policies. We do not have the ability to process refunds. To request a refund, please contact the Application Store directly.

4. User Accounts

While the core functionality of the Service does not require an account, certain features, such as cloud backup, may require you to authenticate with a third-party service (e.g., Google Sign-In for Google Drive). You are responsible for safeguarding your third-party account credentials and for any activities or actions under that account.

5. User-Generated Content and AI Features

You are solely responsible for the content you create and manage within the Application, including all financial data, text, voice recordings, and images ("User Content"). By using our AI-powered features (such as "Voice Accounting" or "Screenshot Accounting"), You grant Us and our third-party Service Providers (e.g., AI service providers like OpenAI or Google) a worldwide, non-exclusive, royalty-free license to use, process, and transmit your User Content solely for the purpose of providing and improving these specific features.

You agree not to use these features to process any illegal, harmful, or infringing content. We reserve the right to suspend or terminate your access for any misuse of the Service.

6. Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company. We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

7. Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits or loss of data).

9. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" without warranty of any kind. We do not warrant that the Service will meet Your requirements, operate without interruption, or be error-free. The data and analysis provided by the Service, including from AI features, are for informational purposes only and should not be considered as financial advice.

10. Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service.

11. Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms and Conditions within the Application or on our website. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
